v In 1973, the Supreme Court’s ruling in Roe v. Wade struck down our law protecting women and babies from abortion. Texas’ original ban has never been repealed.
v Since that time Texans have made every effort to regulate and limit abortion to the fullest extent allowed by the courts.
v Seeing no further attempt to ban abortion, the U.S. Court of Appeals for the Fifth Circuit recently asserted that our ban had been “repealed by implication.”
v Technology has put Roe on a collision course with itself, and a reversal of the 1973 decision could be forthcoming. At that point, the debate in Texas should begin with the pre-Roe ban in effect.
v An Abortion “Trigger Ban” legislation will restore the Texas ban on abortion when Roe falls.
